Terms of Service
The ground rules for using DraftBay — written to be read, not skimmed past.
Last updated: October 5, 2026
These Terms of Service (“Terms”) are an agreement between you and DraftBay (“DraftBay”, “we”, “us”). They cover your use of the DraftBay web app at draftbay.ai and our website (together, the “Service”).
By creating an account or using the Service, you agree to these Terms. If you’re signing up on behalf of a company or organization, you confirm you’re allowed to accept these Terms for it, and “you” includes that organization.

1. What DraftBay is
DraftBay is a web app for planning website structure (sitemaps), managing website copy, running review and approval workflows, collaborating with your team, and getting help from an AI assistant. We’re always improving the Service, so features may be added, changed, or removed over time.
2. Accounts and workspaces
- You need an account to use DraftBay. Please give accurate information and keep it up to date.
- Keep your login secure and don’t share it. You’re responsible for what happens under your account.
- A workspace is your team’s space in DraftBay. The person who creates it is the workspace owner and controls who is invited and what they can do.
- You’re responsible for the people you invite and for making sure you have permission to add their names and emails.
- Tell us right away at info@draftbay.ai if you think your account has been accessed without permission.
3. Free trial
- Every new workspace gets a 14-day free trial. No card is required to start.
- When the trial ends, the workspace becomes read-only until a plan is purchased. You can still see your work, and your data is kept.
- Buying a plan restores full editing.
4. Plans, billing and cancellation
- Per workspace: subscriptions are priced per workspace, not per person.
- Price: the standard plan is $19 USD per month per workspace.
- Billing: plans are billed monthly, in advance, in US dollars, through our payment provider Stripe. Your subscription renews automatically each month until you cancel.
- Taxes: prices don’t include taxes. Sales tax, GST/HST, VAT, or similar taxes may be added depending on where you are.
- Cancelling: you can cancel any time from the billing portal. You keep access until the end of the period you’ve already paid for.
- Refunds: we don’t give refunds for partial months, unless the law requires it.
- Price changes: we may change prices. We’ll give you at least 30 days’ notice before a new price applies to you. Founding Member pricing works differently — see section 5.
- Failed payments: if a payment fails and isn’t fixed, we may make the workspace read-only or suspend it until the account is brought up to date.
5. Founding Member program
In short: the first 100 paying workspaces can lock in $7.99 USD a month, billed yearly ($95.88 USD per year), for as long as they stay subscribed. In return, founding members help us test DraftBay and share their honest experience.
The offer
- The program is limited to the first 100 paying workspaces.
- The founding price is $95.88 USD per year per workspace (the same as $7.99 USD a month), plus any applicable taxes. It is billed once a year, in advance, and renews yearly at the same price.
- That price is locked for as long as the workspace’s subscription stays continuously active. Standard price changes won’t apply to it.
- If the subscription is cancelled or lapses, the founding price ends and can’t be restored. If you subscribe again later, the standard price applies.
What founding members agree to
- Help us test. During your first 90 days as a founding member, take part in at least one short feedback survey, and report any bugs you run into.
- Share your honest experience publicly. Within your first 90 days, make at least two posts about DraftBay on your own channels — for example LinkedIn, X, a blog, or a community you belong to.
Honesty and disclosure
- Disclose in every post. Each post, video, or comment about DraftBay must clearly say you get a discount from us — at the start or near the top, not only in your bio or buried in hashtags. For example: “#ad — I’m a DraftBay Founding Member, so I get a discounted subscription for testing it and posting about it. Opinions are my own.” Advertising and endorsement rules in Canada (Competition Bureau) and the United States (FTC) require this.
- Your honest opinion, always. We will never ask you to say anything untrue or only positive things, and your discount does not depend on what you say — good or bad. Criticism is welcome.
- Only talk about what you’ve actually experienced, and don’t make claims about DraftBay you haven’t checked yourself.
- We may look at public posts about DraftBay and ask you to fix a missing or unclear disclosure.
- Review sites are separate. Reviews on sites like G2 or Capterra are never part of this program and your discount is never tied to them — those sites have their own rules. Please don’t ask others to upvote DraftBay, or trade upvotes, on Product Hunt or similar sites.
“Your first 90 days” means the 90 days after your founding-price subscription starts.
If you don’t take part
If a founding member doesn’t take part as described above, we may reach out and ask them to. If they still don’t, we reserve the right to move the workspace to the standard price with 30 days’ notice.
Ending the program
We may close the program to new sign-ups at any time. Existing founding prices will continue to be honoured as described in this section.
6. Your content
- You own your content — the site structures, page names, copy, comments, links, and files you put into DraftBay.
- You give us permission to store, process, display, and transmit your content only as needed to run the Service for you (for example, showing it to your team, sending notification emails, or answering an AI assistant request you make).
- You’re responsible for your content and for having the rights to use it.
- How we handle personal information is explained in our Privacy Policy.
- If you leave, you can ask us for an export of your data, or ask us to delete it, by emailing info@draftbay.ai.
7. The AI assistant
- The AI assistant is optional. When you use it, relevant workspace information is sent to our AI provider (Anthropic) to generate an answer. The project Board also runs one automatic AI review of each active project per day (page names, copy status, Board items and answers, team notes) to suggest tasks and questions. We do not use your content to train AI models.
- AI can make mistakes. Please review anything it suggests before you rely on it or publish it. You’re responsible for how you use its output.
8. Acceptable use
Please use DraftBay fairly and legally. You agree not to:
- Upload or share anything illegal, harmful, hateful, or that infringes someone else’s rights (including copyright and privacy).
- Upload malware or anything designed to cause damage.
- Try to break into, probe, scan, or test the security of the Service without our written permission.
- Try to access other customers’ workspaces or data.
- Overload, disrupt, or interfere with the Service, or use automated tools to scrape it.
- Copy, reverse-engineer, or build a competing product from the Service.
- Resell, rent, or share access to the Service without our permission.
- Use DraftBay to send spam or unsolicited messages.
9. Our property
DraftBay — the software, design, and brand — belongs to us. These Terms give you the right to use the Service while your account is in good standing; they don’t transfer ownership of anything of ours to you. If you send us feedback or ideas, we may use them to improve DraftBay without owing you anything.
10. Third-party services
DraftBay relies on other companies (such as our hosting, payment, email, and AI providers) and may link to tools you use, like SharePoint or Google Drive. We’re not responsible for those third-party services, and your use of them is governed by their own terms.
11. Suspension and termination
- You can stop using DraftBay and cancel your subscription at any time.
- We may suspend or close an account or workspace for non-payment, for breaking these Terms, for abuse, or to protect the Service, other customers, or the public. Where reasonable, we’ll warn you first and give you a chance to fix the problem.
- If your account is closed, you can ask for an export of your data within a reasonable time, unless the closure was due to serious abuse or the law prevents it.
12. Service provided “as is”
We work hard to keep DraftBay reliable and useful, but the Service is provided “as is” and “as available”. To the extent the law allows, we don’t make promises or guarantees beyond what’s written in these Terms — including that the Service will always be available, error-free, or fit for a particular purpose. Please keep your own copies of anything critical.
13. Limitation of liability
To the extent the law allows:
- We aren’t liable for indirect or consequential losses, such as lost profits, lost revenue, lost data, or business interruption.
- Our total liability for any claim related to the Service is limited to the fees you paid us in the 12 months before the claim.
Some places don’t allow these limits, so they may not fully apply to you.
14. Your responsibility to us
If someone makes a claim against us because of your content or because you broke these Terms, you agree to cover the reasonable costs and losses that result, to the extent the law allows.
15. Governing law and disputes
These Terms are governed by the laws of Canada and the applicable province where DraftBay is based. If a problem comes up, please email us first at info@draftbay.ai — most things can be sorted out quickly and informally. Any dispute that can’t be resolved that way will be handled under those laws.
16. Changes to these Terms
We may update these Terms from time to time. We’ll change the “Last updated” date above, and for important changes we’ll notify account owners by email or in the app before they take effect. If you keep using DraftBay after changes take effect, you accept the updated Terms. If you don’t agree, you can cancel at any time.
17. General
- These Terms and our Privacy Policy are the full agreement between you and us about the Service.
- If any part of these Terms can’t be enforced, the rest still applies.
- If we don’t enforce something right away, we haven’t given up the right to enforce it later.
- You can’t transfer your account or these Terms to someone else without our permission. We may transfer them as part of a merger, acquisition, or sale of the business.
- We’re not responsible for delays or failures caused by events outside our reasonable control.
